Murder suspect expected in court

The man arrested in the murder of Cumberland Gap business owner Harvey Fuson is expected in court today.

Donnie Smith, 33, of Cannon Creek Lake Hill in Middlesboro, Ky., was indicted in April of this year by the Grand Jury for Criminal Court in Claiborne County. Smith was charged with first-degree murder.

Fuson, 66, of Harrogate, Tenn., was discovered murdered on January 25, 2011, in his store, The Old Drug Store in Cumberland Gap, Tenn. Fuson’s wife discovered him unconscious in a puddle of blood on the floor of his store shortly after 1 p.m.

The Claiborne County Sheriff’s Office, TBI Special Agent Jerry Spoon and the Tennessee Bureau of Investigation, Cumberland Gap Police Department, the U.S. Marshal’s Service, the National Park Service, the Eighth Judicial Drug Task Force and the Eighth Judicial District Attorney General’s Office investigated Fuson’s death. The Middlesboro Police Department, Bell County Sheriff’s Department and the Knox County Tennessee Sheriff’s Department all assisted in the investigation as well.

Criminal Court Judge E. Shayne Sexton ordered a Capias for the arrest of Smith. He was arrested and taken to the Claiborne County Jail where he was given a $1-million bond.
