Sexton handles criminal plea agreements

Judge Shayne Sexton handled several plea agreements recently, during sessions in Claiborne Criminal Court.

Toni Amodio, 36, charged with aggravated child abuse, was sentenced to seven years at 35 percent confinement on the reduced charge of attempted aggravated child abuse. Amodio was given credit for 478 days of jail time already served. In a separate case, she was charged with simple possession of methamphetamine and possession of drug paraphernalia. Amodio was sentenced in this case to a concurrent 11 months, 29 days at 75 percent confinement and given jail credit for any time served since Jan. 7, 2016.

Jonathan Edward Thomas, 39, charged with aggravated child abuse, was sentenced to six years at 30 percent confinement on the reduced charge of aggravated assault. Thomas was given credit for 584 days of jail time.

Gary Wayne Wolfenbarger, 54, charged with child endangerment and driving under the influence (third offense), was sentenced to two years at 30 percent confinement on the first charge and 11 months, 29 days confinement on the second one. Wolfenbarger was given credit for any jail time served from Nov. 20, 2016 through Aug. 9 of last year.

Quandrus Fanney, 44, charged with child neglect, was sentenced to two years TDOC supervised probation. Fanney must pay at least $75 per month in court costs and fines.

Jason Benjamin Dailey, 38, charged with reckless aggravated assault, was sentenced to four years at 35 percent confinement. Dailey is barred from any unlawful contact with his victim, who requested the court to allow Dailey to avail himself of any mental health services, specifically any to address post-traumatic stress disorder, available through the Tennessee Department of Corrections, while in its custody.

Daniel Fitzpatrick, 30, charged with one count each of aggravated assault and possession of methamphetamine, was sentenced to a concurrent split confinement of three years TDOC supervised probation with 90 days confinement. Fitzpatrick was given credit for any jail time served from Oct. 31 to Jan. 22. He must pay at least $75 per month in court costs and fines and $300 in restitution to the Tazewell Police Department. He must complete an anger management course and undergo a mental health evaluation.

Octavian Emil Vasilescu, 34, charged with aggravated assault, was sentenced to six months unsupervised probation on the reduced charge of assault. As a condition of his probationary status, Vasilescu was ordered to pay all court costs and fines in full the day of his hearing.

Michael Dean Terry, 34, was charged with one count each aggravated statutory rape and the sexual exploitation of a minor via over 100 images, and two counts of soliciting sexual exploitation of a minor. Terry was sentenced to an effective six years confinement on two counts of aggravated statutory rape. This sentence runs consecutively with a felony in Illinois. Terry agreed to undergo blood and urine testing to detect any possible STDs. He agreed to share the results with the state and with his victims. He is barred from any contact with them.

Johnathan Wade Dearing, 43, was charged with attempted especially aggravated sexual exploitation of a minor, attempted sexual exploitation of a minor and unlawful photographing in violation of privacy. Dearing was sentenced to a split confinement of five years TDOC supervised probation with 100 days confinement on the reduced counts of unlawful photographing in violation of privacy and observation without consent. Count one of the original sentence is nolle. Dearing is subject to the Sexual Offender Registration and Restrictions during the term of his five year sentence. He must pay a total $10,000 contribution to the Claiborne County Sheriff’s Office at the rate of $1,000 per month and pay $50 per month in court costs and fines.

Danny Joe Branson, 39, charged with violation of the Sexual Offender Registry Act, was sentenced to a split confinement of two years TDOC supervised probation with 90 days confinement. Branson was given credit for any jail time served from Dec. 5 to Jan. 22. He must pay at least $75 per month in court costs and fines.

Robert Kincaid, 35, charged with one count each of driving under the influence, possession of a handgun while under the influence and failure to maintain traffic lane, was sentenced to a split confinement of 11 months, 29 days TDOC supervised probation with five days confinement on the one count of driving under the influence. Kincaid was given credit for five days of jail time already served. He must pay at least $100 per month in court costs and fines. Kincaid is eligible for unsupervised probation once found fully compliant. His driver’s license is revoked for one year.

Charles Lewis Jones, 25, charged with driving under the influence (second offense), was sentenced to 11 months, 29 days confinement. Jones was given credit for 231 days of jail time already served. His driver’s license is revoked for two years.
